Song covers...?

If I get a band to do a cover of a popular copyrighted song, is it ok to use the cover?

Thats a very tricky subject. I'm guessing that the orginial owner will still hold the copyright to the lyrics, and music????

I believe that Madona got sued for using parts of somebody elses song and in the end they settled out of court. Therefore suggesting its not OK.

I could be wrong

No, not for video. If I recall correctly, there is a compulsory license available for phonorecord covers of phonorecords, but I don't think it would apply film or video soundtracks. Sorry I don't have time to check this, but I'm in the middle of trial prep.

BTW, congrats on the Tom Green video!
