Magazine Reference in Documentaries??
Scenario: Want to scan articles/photos/pages out of magazines to reference and show the media's take on our subject.
Example: Teton Magazine 1971 article on Bill Briggs' first ski descent of the Grand Teton. Usage: Scan the article combined with the photo on the front page with the headline "Grand Teton Get's Skied!" Do I need to get photo usage permission from the original photographer, and then permission from the magazine as well? Magazine is out of print. Thanks for answering yet another legal/usage question. |

The kind of permission you need to get will depend, in part, on the contract the magazine had with the photog. He may have given them rights to the image for a limited time and he may have reserved certain rights not associated with the image's use in that issue of Teton magazine.
Best to start with the photographer and find out then go to the magazine if you need to. You will need permission from whomever owns the relevant rights. |
