Hi,

While searching the web the other day I came across a website that has my video embedded in their banner. The website provides paid and free services. I don't understand the legalities of copyright issues but
there is no mention of me being the owner of the video. I don't mind if they use it but I'd like to be credited and have maybe a link to my website. There is a "report image" button on their website but before I send them a message (not sure how I should word it) I'd like to know how I should proceed and just wanted to know if they have the right to use the embedded video. Any advice would be appreciated.

Contact them, tell them it is your work and to either remove it or purchase the rights to use it. Simple as that. Don't let them talk you into using it for free as it shows weakness on your part.

Is it a vimeo or youtube video? If it's vimeo you could specify which sites are able to embed your video.

Also, on Vimeo, you can specify one of various Creative Commons licenses, if you so wish.

Be warned, once you mark something with a CC license at one level, you can never revoke it or raise the level, so choose wisely. This is reasonable, as one day I might grab content with a CC license that works for me and on the next day an unethical person might try to revoke the license and sue me for using the content. The "licensed forever" thing avoids this bait and switch tactic.
