I’m new to all the legal side of documentaries and filmmaking so they could be a simple answer I’m not seeing.
The question is how does Sacha Baron Cohen get release forms from people in films like Borat and Bruno.
Take the scene where Borat enters a priests home and calls a prostitute to come round. How or why did the priest consent to a release form. I can only see 4 possible answers. 1 they got the release form signed before they started the fun and games, 2 the priest was in on the joke from the start, 3 they didn’t worry about a release form, 4 after they played the joke they gave the priest a lot of money to sign a release form. I have heard that the producers of the films have been being taken to court, but I don’t know the circumstances around this,
The second question is how can they incriminate people that have committed crimes when there is no way the person being filmed would ever consent. There a few programs that specialize in tracking people who have robbed or conned people and they go up to them and ask them why they did the crime and expose them. There is no way you can say to the criminal, ‘oh can you just sign this release form as we want to incriminate you on national TV’. And there is no way after you have incriminated them that they will sign a release form. So how does that work.
